Psilocybin is illegal under United States federal law in every state. A state program licenses facilities inside that state only. It does not change federal law. A licence from one state means nothing in another state. State programs differ, so read the rules of each one.

As of October 2026, two states run an open, licensed program: Oregon and Colorado.

Oregon. The Oregon Psilocybin Services Act (ORS 475A) created the first licensed program. The Oregon Health Authority, Oregon Psilocybin Services section, runs it. Licensed service centers began opening in 2023. Adults 21 or older may take part. No prescription, no medical referral and no Oregon residency is needed. Sessions take place inside a licensed service center with a licensed facilitator, after a preparation session. The program also licenses manufacturers, facilitators and laboratories. On 2026-10-20 the public licensee directory listed 20 service centers, 6 manufacturers, 1 laboratory and 345 facilitators. That directory shows only licensees who agreed to be published, so it is not the full register. Verify a licence with the OHA license-status tool.

Colorado. The Natural Medicine Health Act (Proposition 122) created the program. The Department of Revenue's Natural Medicine Division licenses businesses, including standard and micro healing centers. DORA licenses facilitators. The division also licenses cultivations, manufacturers, testing facilities and handlers. The first healing center licences were issued in late 2025. Adults 21 or older may take part. Sessions take place inside a licensed healing center with a licensed facilitator. On 2026-10-16 the division reported 47 approved healing center licences: 11 standard and 36 micro. Verify a licence with the DORA license look-up or the Natural Medicine Division directory.

New Mexico. New Mexico enacted the Medical Psilocybin Act (SB 219) in April 2025. The Department of Health is writing the rules. No licensed centers are open yet. This is a medical program for patients with qualifying conditions. That is different from the adult-use models in Oregon and Colorado. The department's goal is first patients by the end of 2026.

Every other state. No other state runs a licensed psilocybin service center program. Some cities have made personal possession a low police priority. That is not a licence, and it does not allow supervised sessions or sales. A center outside Oregon or Colorado has no state licence to show. Be careful with any site that calls an unlicensed business legal. Ask which agency issued the licence.

Rules change. This page summarizes the statutes and agency pages as checked on 2026-10-20. Use the free State programs tool on this site for the current summary. This site gives no medical or legal advice. If you are unsure about a rule, contact the state agency or ask a qualified professional.

Questions

Is psilocybin legal where I live?

Psilocybin is illegal under United States federal law in every state. Licensed sessions exist only inside a state program that is open. The State programs tool on this site shows which states have one.

Do I need to live in Oregon to use an Oregon center?

No. Oregon requires no residency. The session must take place inside a licensed Oregon service center, and federal law still applies.
